1. Agreement to terms

By creating an account or using the QuitDuo app ("the app"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app. These Terms incorporate our Privacy Policy by reference.

2. The service

QuitDuo is a habit-change app for cutting down and stopping smoking, built for two people: the Smoker, and an Observer — a friend or family member the Smoker invites to support them. For the Smoker it offers daily logging of cigarettes, cravings and mood, savings, streaks and rewards, motivational messages, in-the-moment tools (breathing, journaling, distraction), an emergency button that also offers a quit-line number where we have one for your country, and a personal 90-day step-down plan. The Observer follows the Smoker's progress, sends pre-written messages of encouragement, and is alerted when a craving runs high or the Smoker asks for support.

An Observer is part of the plan. The Smoker invites their Observer within the first seven days. The step-down plan starts only once an Observer has joined and the Smoker has started the 90-day program; logging, the tools and the emergency button never depend on either (§5, §8).

What is free, and what you can buy. The app is free to install for both roles, and Observers never pay. A Smoker's first seven days are a free trial that includes personal AI-written messages. The step-down plan comes with the 90-day program, a single purchase in the App Store or Google Play that never renews. Logging, your history and savings, streaks, the Observer link and its alerts, all tools, the emergency button, the quit-line, getting a copy of your data and deleting your account stay free either way. The details are in §8.

3. Medical disclaimer (important)

QuitDuo does not provide medical advice and is not a medical device. Its content, plans, messages, and reward scores are for motivational and behavioral support only and are not a substitute for professional medical or psychological advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions about a medical condition, medication, or quitting method. If you are experiencing a medical emergency, contact your local emergency services immediately. The in-app emergency button and quit-line links are conveniences, not emergency services.

4. Eligibility and accounts

5. The Observer

Inviting your Observer. If you are a Smoker, you invite one Observer — someone you trust — within your first seven days, your observation week. You can still invite one later, but until an Observer has joined, your step-down plan waits. Before your invite code is created, the app shows you what your Observer will and will never see, and you agree to share it by tapping Agree & create my code. Your Observer installs QuitDuo, signs up as an Observer and enters your code. A Smoker has one Observer at a time, and an Observer supports one Smoker at a time.

Your plan needs your Observer. Without a linked Observer, your step-down plan waits: your daily target holds, and the step-down starts only once your Observer has joined and your 90-day program has started (§8). If the link ends while your step-down is running — because either of you ends it, or your Observer deletes their account — your plan pauses, and your daily target holds until a new Observer joins. A program's 90 days keep running while your plan waits or is paused, and they are never extended. Logging, the tools, the emergency button, the quit-line, getting a copy of your data and deleting your account never depend on an Observer and are never locked.

What each of you sees. While the link is active, your Observer sees your nickname; your logs — cravings with their level, cigarettes and check-ins, including the optional mood, with their times and the technical details stored with each entry; your progress, streaks, reward meter and badges; the pre-written messages you send each other; and alerts when a craving runs high (7 or more on the 1–10 scale) or when you ask them for support — an alert for a craving of 7 or 8 is sent at most once every two hours, so that they are not flooded. Your Observer never sees your email address, your real name (unless you chose it as your nickname), your craving notes or your journal. Of your Observer, the app shows you only their nickname, the messages they send you and whether an alert was sent to them. The Privacy Policy describes this sharing in full.

Ending the link, blocking and reporting. Either of you can end the link at any time in Settings. When a link ends, the Observer's access stops at once, both nicknames are removed from the link, and that link's alerts are deleted. You can also block the other person: this ends the link and stops them from linking with you again until you unblock them in Settings. You can report the other person — or a message your Observer sent you — in the app. A report, with the reason you choose and what you are reporting, comes to us, and we review every report, usually within 24 hours. If you are an Observer, you agree to use what you see only to support the Smoker and to keep it to yourself. Only enter an invite code that the Smoker gave you themselves.

6. Acceptable use and zero tolerance for abuse

Zero tolerance. There is no tolerance on QuitDuo for objectionable content or abusive users. Harassment, bullying, threats, hate speech, sexual content and any other abuse of another person are not allowed. Where we find it, we remove the content and may suspend or permanently close the account responsible — in serious cases without prior notice.

Messages between partners are pre-written: neither of you can type a message to the other, so your nickname is the only text you write that the other person sees. It must not be offensive, hateful, sexual, threatening or harassing, and it must not impersonate anyone. The app screens nicknames for abusive words and refuses those it catches. While you are linked, you can report or block the other person in the app (§5), and you can always write to us at hello@aiovent.com about anything that worries you.

QuitDuo is for personal, non-commercial use — your own quit journey, or supporting someone on theirs. You agree not to: misuse or disrupt the service; attempt unauthorized access to the app, our systems or another person's data; reverse-engineer the app except as permitted by law; file reports you know to be false; or use the app to harm another person. We may suspend or terminate accounts that violate these Terms.

7. Rewards and reviews

Rewards (badges, milestone unlocks) are earned by reaching in-app milestones — for example, completing 90 smoke-free days. Rewards are never conditioned on writing, or on the content of, an app-store review or rating. Any request to review the app is optional and unincentivized.

8. Purchases and payment

Free to install, and free for Observers. The app is free to install for both roles, and Observers never pay.

Your free trial. As a Smoker, your first seven days are a free trial — the day you sign up is day 1. The trial includes personal AI-written messages when you log a craving. It costs nothing and ends on its own; nothing is charged when it ends.

The 90-day program. The paid product is one 90-day program, bought with a single payment in the App Store or Google Play. It is shown as €49.99; the price your store shows you at checkout, in your currency, is the one that applies. It is not a subscription: it never renews, and nothing is charged again automatically. Its 90 days count from the day you buy it — the purchase day is day 1 and day 90 is the last — and they keep running while your plan waits or is paused for an Observer (§5); they are never extended. The program includes:

Personal AI-written messages when you log a craving are subject to a daily limit; beyond it, or when the AI service is unavailable, the app shows a message from its built-in library instead. The app offers the program once your plan is ready — normally after your first seven days — and your Observer has joined. A purchase unlocks the program for the QuitDuo account you are signed in with. Starting again later is a new purchase of a new 90-day program; if you start one while a program is still running, the running program ends that day and its remaining days do not carry over.

Without a purchase, the step-down plan does not start, and personal AI-written messages end with your free trial — the app then shows messages from its built-in library instead. These always stay free: logging and your history, savings, streaks, the Observer link and its push alerts, all tools, the emergency button, the quit-line, getting a copy of your data and deleting your account.

No discounts, no incentives. QuitDuo never offers money, discounts, promo codes, vouchers or prizes — not for quitting, not for using the app and not for a review.

Your contractual partner for the purchase is the app store, not Aiovent: Apple (Apple Distribution International Ltd.) for the App Store and Google (Google Commerce Ltd.) for Google Play. They act as seller of record, collect the price including any applicable VAT, and issue your receipt. We never receive or process your payment card data.

Refunds, cancellations, and any statutory right of withdrawal for the purchase are therefore handled by the relevant store under its own policy — please raise refund requests directly with Apple or Google. If the store refunds a purchase, the program it unlocked may end. If something has gone wrong with the app itself, contact us at hello@aiovent.com and we will help.

We do not remove features from a program you have already bought while its 90 days are running. The program is a plan and support, not a promise of a result: we cannot guarantee that you will cut down or stop smoking.

9. Your content

You retain your rights in the content you create (logs, notes, journal entries, your nickname). You grant Aiovent a limited licence to process and display it as needed to operate the app for you and — only as described in §5 — for your linked partner, consistent with the Privacy Policy.

10. Third-party services

The app relies on these third-party services:

Their availability is not guaranteed by us, and their own terms may also apply. If our server or the AI service is unavailable, the app shows messages from its built-in library instead, and logging and alerts to your Observer carry on.

11. Availability, changes, and beta features

We may modify, suspend, or discontinue features at any time, subject to what §8 says about a program you have already bought. Features may be offered as beta and change or be removed. We aim for high availability but do not guarantee uninterrupted service.

12. Disclaimers and limitation of liability

We are liable without limitation for damages arising from injury to life, body, or health, for damages caused intentionally or by gross negligence, under the German Product Liability Act (Produkthaftungsgesetz), and to the extent we have given a guarantee.

For slight negligence, we are liable only where we breach an essential contractual obligation — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely — and in that case only for foreseeable damage typical of this type of contract. Any further liability for slight negligence is excluded.

Beyond that, the app is provided on an "as is" and "as available" basis. Your statutory rights as a consumer are unaffected by these Terms.

13. Termination

You may stop using the app and delete your account at any time, free of charge — in the app under Settings → Privacy & data → Delete my account, or by email if you have already uninstalled it; both routes are set out on Delete your account. Deletion is permanent, so if you want a copy of your data, ask us at hello@aiovent.com first — we answer within one month — and delete your account only once you have received it.

Deleting your account ends any Observer link you have — if you are an Observer, the Smoker then needs a new Observer for their step-down plan (§5) — and ends any program you have bought. It does not by itself refund a purchase; refunds are handled by the store (§8).

We may suspend or terminate access for breach of these Terms (see §6). Provisions that by their nature should survive termination (for example disclaimers and liability limits) survive.

14. Governing law and disputes

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another country, this choice of law does not deprive you of the protection of mandatory provisions of the law of that country.

We are not willing or obliged to take part in dispute-resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).

15. Changes to these Terms

We may update these Terms. If a change is material, the app asks you to accept the new Terms before you continue; until then the version you accepted applies.
